After the loss of a loved one, his relatives, who are taking the deceased to the last trip, forget about the compensations due to them, which can ease the financial burden associated with organizing the funeral. After the death of an elderly citizen who has gone on a well-deserved rest, his family members are entitled to accruals, which should become material support to those who have suffered a heavy loss.

What payments are due after the death of a pensioner

Relatives of the old man, who was charged security, have the right to collect the pension due in the current month, but not received in connection with his death. If several family members apply for the indicated amounts, all the allocated funds are divided equally between them. You can receive the following types of retirement benefits:

  • cumulative;
  • insurance;
  • military.

The territorial unit of the Pension Fund of Russia (hereinafter referred to as the FIU) issues a certificate on the amounts of benefits that have not been paid in life to a registered citizen. Relatives of the deceased can receive the document within 6 months from the date of his death on the basis of a request from a notary and upon request. Relatives are also entitled to apply for registration of a funeral allowance in the amount of 5,701.31 rubles according to the indexation carried out in 2019.

Social Benefit for Burial

A lump sum payment (5,701.31 rubles), which is obligatory state financial support to citizens who undertook the organization of the funeral of the deceased and applied for appropriate compensation, is called a social burial allowance. Persons who receive funeral services from the guaranteed list free of charge, this subsidy is not assigned.

Lost pension for deceased pensioner

If a citizen died before he managed to receive the security accrued to him for a month, it is due to his close relatives. The corresponding pension payment after the death of a pensioner may be:

  • transferred to the applicant;
  • left in the budget of the FIU (provided that the deceased has no relatives).

We are talking about lost payments due to a citizen who passed away during the period from 1 to 30/31 of the current month. Unpaid amounts will be available to relatives and family members. Such charges may include:

  • federal pension (in accordance with Clause 1, Article 12 of the Federal Law of the Russian Federation dated 07.17.1999 No. 178-FZ as amended on 07.03.2018);
  • monthly cash payment for privileged categories of citizens:
  1. veterans of World War II (hereinafter – the Second World War) and other military operations;
  2. military pensioners
  3. Chernobyl residents;
  • severance pay for an elderly person upon dismissal (in accordance with Article 178 of the Labor Code of the Russian Federation);
  • cost compensation for:
  1. use of public urban transport;
  2. payment of housing and communal services;
  3. purchase of drugs.

Getting a pension after the death of a pensioner

In order to apply for an unpaid pension, a written application should be drawn up and the FIU should apply to it. This must be done no later than six months from the date of death of the citizen. The applicant – a family member or close relative of the deceased – is entitled to apply only for the pension accrued to the deceased in the current month, which the latter could not receive due to his death.

What part of the pension is inherited

After the death of a person who has gone on a well-deserved rest, his successors inherit the funded part of the allowance, which the deceased managed to issue in his lifetime, but never received it. The insurance pension after the death of a pensioner, accrued to him in the current month, but unpaid in connection with his death, is also subject to transfer to his family members or close relatives. In this case, it is not considered.

Who can claim to receive

After the death of a citizen, a part of the state provision not received by him for the current month is paid to relatives who lived with the deceased on the same living space. These include:

  • husband wife;
  • children;
  • brothers / sisters;
  • grandchildren.

Persons who, during the life of a deceased citizen, were dependent on him, may apply for a part of the social allowance that he has not received and a funeral grant irrespective of the fact of cohabitation. They can be:

  • children of the deceased who have not reached the age of majority;
  • other senior citizens;
  • disabled people.

Features of inheritance of the funded part of the pension

In contrast to the insurance part of the pension – the social benefit guaranteed by the state – funded has a special difference and advantage: it can be inherited and must be transferred to successors. A citizen who has gone on a well-deserved rest has the right to bequeath it to a third party at any time. In the event of the death of a pensioner, his heir will receive the due funds according to:

  • Application for the allocation of funds (Appendix No. 1 to the Rules for the payment by the PFR of the successor of the deceased insured person of pension savings funds recorded in the special part of the individual personal account). Any person can be the heirs – they are indicated in the document, which also provides for the establishment of the amount of payments due to them..
  • Russian legislation.

The successor part of the allowance established to the pensioner is indefinite, the successors cannot inherit. You can get it for a deceased citizen only in the following cases:

  • Senior citizen died before her appointment.
  • A person who went on a well-deserved rest was issued a lump-sum payment of the funded part of the pension, but he did not manage to receive it during his lifetime.
  • The deceased was assigned an urgent transfer of security, which was never carried out in connection with his death. If a citizen managed to take part of his accumulative allowance during his life, the heirs are supposed to have his rest minus the amount already received by the deceased before his death.

How to get the pension of a deceased pensioner

To apply for and receive the pension of a deceased citizen, you must adhere to a number of formalities. The procedure is not particularly difficult:

  1. Collect the package of necessary documents – it will depend on the length of service, status and position of the deceased before his death.
  2. Contact the relevant papers and the application for registration of the lost pension to the authorized body responsible for its accrual.
  3. Wait until the pension is transferred to the bank account specified in the details.

  1. notarized power of attorney to an individual to receive payments due to the deceased;
  2. court decision (on disputed charges, if it was positive).

Payments for the burial of a pensioner

The social subsidization of the burial is provided in order to compensate the responsible persons for part of the cost of the funeral of the deceased citizen. The payment of benefits is mainly carried out by the FIU. Close relatives, family members or other persons entitled to claim compensation for a funeral in a pension fund are the organizers who have taken responsibility for seeing the deceased in the last journey:

  • execution of necessary documents,
  • purchase of the coffin and ritual accessories,
  • transport,
  • burial.

Who needs material assistance for burial?

Any citizen who undertook to organize the funeral of a deceased pensioner and incurred financial expenses in connection with these actions has the right to receive a funeral grant. Neither the fact of kinship, nor its degree, nor cohabitation are mandatory conditions when processing compensation. The funeral grant is due:

  • spouse
  • close relatives: parents, children, sisters and brothers, grandchildren;
  • distant relatives;
  • legal representatives of the deceased (by proxy): parents, adoptive parents, guardians, trustees;
  • other persons incurring expenses in connection with the organization of the funeral of the deceased: colleagues, neighbors, friends, acquaintances.

A citizen who has undertaken financial obligations to pay for the funeral of a military pensioner is entitled to a special social payment. It is of three types:

  • standard – its size is fixed and known in advance;
  • compensation for actually incurred expenses (the funeral organizer will need to provide documentary evidence of all expenses), which cannot exceed:
  1. for Moscow and St. Petersburg – 25,269 rubles;
  2. for other regions of the Russian Federation – 18,250 rubles;
  • burial subsidy equal to three times the size of the last pension or salary received, provided that the total amount is not less than the social allowance.

The applicant should determine the type of payment after the death of a pensioner – according to the law, he has the right to issue only one of three. He can use the service of making a monument at the grave of a soldier free of charge – in this case, all the expenses are compensated by the military commissariat. Tombstone will have to be ordered in one of the municipal funeral services – the regional branch of the Ministry of Defense has the right to pay only with such organizations.

  • branch of the FIU at the place of registration of the deceased citizen, if he received a pension;
  • organization – the employer of the deceased, if he was officially employed, or the Social Insurance Fund (hereinafter – the Social Insurance Fund);
  • military registration and enlistment office – the institution is responsible for calculating funeral subsidies:
  1. veterans of the Great Patriotic War, military operations;
  2. police officers;
  3. military personnel;
  4. employees of law enforcement agencies;
  5. firefighters;
  6. former military personnel;
  7. customs officers;
  8. tax officers;
  • the regional social security agency to which the deceased was attached during his life at the place of permanent registration, provided that he was unemployed, was not a pensioner or a former soldier.

Order of registration

In order to receive a funeral grant, the person responsible for the funeral of a pensioner should follow a certain procedure. Their step-by-step algorithm will look like this:

  1. Collect the necessary package of documents.
  2. Decide on the type of social payment after the death of a pensioner.
  3. Apply with documents and application for funeral allowance to the authorized body responsible for its accrual.
